• Victim takes rifle from shooter in struggle, breaks it into pieces

    CUBA, Mo. — A Missouri man was arrested after calling 911 and telling investigators he was assaulted with a stick by an alleged assailant
    Thursday in Cuba, Missouri, investigators said.

    A deputy with the Crawford County Sheriff's Office spoke to the 76-year-
    old man who reported the assault, Cuba resident Guy Curtis Link.

    After looking into Link's report, the deputy found Link had shot a rifle
    at a man who then confronted Link.

    When the victim confronted the shooter, the shooter pointed the rifle at
    the victim again, but this time, in close proximity, according to court records.

    "Fearing the defendant may discharge the rifle again, [the victim] grabbed
    the barrel of the rifle, and a struggle ensued," the deputy wrote. "During
    the struggle, the rifle was discharged a second time into the air next to
    the victim."

    That's when the victim took the rifle from the shooter and struck him with
    it several times in while defending himself, the deputy wrote. The victim
    told the deputy he thought the rifle was a .22 caliber weapon with a brown
    and wood stock.

    "The victim said when he struck the defendant [with] the rifle, the rifle
    broke into two pieces," the deputy wrote. "The victim said he then left
    and walked to his residence that was located approximately a quarter mile away."

    Link refused to submit to a Gun Shot Residue Test and told deputies he
    didn't want to give them any extra evidence and that they already had
    enough.

    "During a search of the area where the [Link] said the altercation took
    place, deputies located two .22 caliber empty shell casings and a brown
    rifle stock like the victim described," the sheriff's deputy wrote. "The
    barrel portion was not located."

    Link faces second-degree assault, armed criminal action, and unlawful use
    of weapon charges, court records said— all are felonies.

    His Bond was set at $50,000.
