    ORDER

    UPON MOTION in writing on behalf of the defendant, filed
    July 4, 2023 pursuant to Rule 369 of the Federal Courts
    Rules, SOR/98-106 ("Rules"), for an order pursuant to Rule 8
    extending the defendant's deadline to serve and file cost
    submissions;

    AND UPON reading the defendant's submissions, there being no
    responding submissions on behalf of the plaintiffs;

    AND UPON being satisfied that, upon consideration of the
    factors identified in Canada (Attorney General) v Hennelly,
    1999 CanLII 8190 (FCA) and the interests of justice, an
    extension of time should be granted;

    AND UPON concluding that any revised deadline should be
    peremptory on the defendant;

    THIS COURT ORDERS that:

    1. The deadline for the defendant to serve and file
    submissions as to costs is extended to July 25, 2023. This
    deadline is peremptory on the defendant, and will not be
    extended further.

    2. The deadline for the plaintiffs in T-138-21, and each of
    the Court files listed in Annex A to this order, to serve
    and file responding submissions as to costs, is extended to
    August 4, 2023.

    3. A copy of this order shall be placed in Court file T-138-
    21, and each of the Court files listed in Annex A.

    ANNEX A

    JCT: So the Crown will be filing a request for costs by July
    25 and then all the plaintiffs will have the chance to ask
    for less by Aug 4 2023.

    I've already explained how to file a submission letter if
    you want but let's see what the Crown has to say, if any
    different from their last request.
