America First Legal has lodged a state bar complaint against New York
Attorney General Letitia James over alleged mortgage fraud. The complaint followed a criminal referral from U.S. Federal Housing Finance Agency
Director William J. Pulte to the Justice Department. Pulte claimed that
James falsified bank documents and property records to secure government- backed assistance and loans.
Pulte outlined two main allegations against James. The first involves her purchasing a property in Norfolk, Virginia, two years ago, where she
falsely indicated it was her primary residence while serving as attorney general in New York.
Pulte said, “This has potentially included 1) falsifying residence status
for a Norfolk, Virginia-based home in order to secure a lower mortgage
rate and 2) misrepresenting property descriptions to meet stringent requirements for government-backed loans and government assistance.”
Pulte’s second allegation pertains to her misrepresentation of housing
units in a Brooklyn property to obtain a more favorable mortgage interest
rate.
America First Legal asserted that if these claims are substantiated, James
may have violated Rules 8.4(b) and 8.4(c) of the New York Rules of
Professional Conduct. The rules prohibit attorneys from engaging in
illegal conduct that undermines their integrity.
America First Legal Vice President Dan Epstein noted that the allegations,
if proven true, would signify that the sitting state Attorney General made false certifications to obtain federal benefits. Epstein criticized James
for prioritizing her political agenda over ethical duties.
Epstein said, “For a state prosecutor who has maligned the President of
the United States for political gain, public accountability will serve as
a cure to Letitia James’ endless lawfare and abuse of power.”
Epstein added, “If what Director Pulte uncovered is true, then we have a sitting state Attorney General who made false certifications to the United States in return for federal benefits.”
Epstein said, “But why worry about committing fraud against American
taxpayers when you are willing to buck your ethical duties to the bar? For
a state prosecutor who has maligned the President of the United States for political gain, public accountability will serve as a cure to Letitia
James’ endless lawfare and abuse of power.”
James has denied all allegations, asserting that the claims are baseless
and part of a “revenge tour.” James said, “Let me just say to all New
Yorkers and to all Americans: the allegations are baseless.”
James added, “The allegations are nothing more than a revenge tour. As you know, as any good attorney, I will not litigate this case in a camera. It
is important that we respond to these allegations at the appropriate time
and in an appropriate way.”
