    | H-1B visa holders may have an ownership stake in the company
    | sponsoring their visa, but must demonstrate an employer-employee
    | relationship exists with the company. As a condition for when an H-
    | 1B beneficiary holds a controlling interest in a petitioning
    | business, the visa holder can perform duties related to owning and
    | directing the business as long as they perform specialty occupation
    | duties a majority of the time.

    | The DHS is also proposing to limit the duration of visas sought by
    | beneficiary-owned businesses to 18 months for the initial visa
    | petition and first extension.
