| The justices declined to take the case last year, leaving in place a
| district court ruling that tossed the lawsuit from Save Jobs USA.
| But an appeal is ongoing at the US Court of Appeals for the District
| of Columbia Circuit, where the group aims to invalidate a program
| extending employment eligibility to more than 90,000 H-4 visa
| holders.

| The district court last year found that the Department of Homeland
| Security had clear authority under the Immigration and Nationality
| Act to establish the employment authorization program for H-4 visas
| holders, most of them spouses of tech sector workers. Employer
| groups like the US Chamber of Commerce have argued the option for
| spouses to work in the US was key for recruitment of high-skilled
| foreign workers.
