    owner, sues team for having been struck in the face with a foul ball. In
    part, the lawsuit blames that the team sucks, so attendees have no
    reason to pay attention to the game and the man had no warning of the

    Yeah, you can put anything in the pleadings of a lawsuit but that seems
    absurd.

    Does no one take responsibility for their own actions any more? Is
    absolutely EVERYTHING someone else's fault and never your own?

    I'm reminded of a story I heard many years ago about a young man whose
    parents were attractive, smart, and successful. He sued them because he
    was ugly, stupid, and a loser. The judge laughed him out of court.

    There is a law in Colorado that precludes such lawsuits. I don't know
    that I agree that someone attending a game takes on the entire
    responsibility of being struck with a foul ball but that's what the
    adhesion contract likely says. He's desperate to get around state law,
    so he came up with something stupid to argue.

    I wonder if he attempted to try to live his own life, he might have

    I assume the suit will get thrown out for those reasons and state law.
    It was just so ridiculous: Sight lines (toward home plate) were poor
    from the luxury box and there was other stuff to do in the box aside
    from watching the game, so he can't be held responsible for receiving
    the injury. He might have had time to duck if he'd been watching.

    I figured people on Usenet would appreciate the absurdity.
