    Note the use of the phrase "alleges facts".

    That means that judge is saying that if the facts can be proven
    to the satisfaction of the triers of fact (i.e. the jur.y),
    then those facts are sufficient for punitive damages to be
    awarded.

    extreme negligence not only in the management of the operation, the
    training of everyone involved, adherence to safety regulations, and

    weapon at several crew members seriously injuring one and killing the
