• Woman who caused fatal crash while drunk and on drugs is jailed

From Simon Mason@21:1/5 to All on Thu Nov 23 08:34:46 2023
A woman who crashed her car into a tree while drunk and on drugs, killing one man and seriously injuring another, has been jailed.

Rachael Boardman was also speeding at the time of the collision, which occurred in the early hours of the morning after she had spent the evening at home with friends drinking heavily and taking drugs.

Dominic Fryer, the rear seat passenger in Boardman’s Peugeot 206, was not wearing a seatbelt. He died at the scene.

Paying tribute to the 51-year-old, from Netherseal, his family have expressed their devastation at the loss of an ‘amazing’ husband, father and grandfather.

In a victim personal statement read out in court, his wife Kristy said: “My husband Dom was everything to me. He did everything for me. We had three wonderful children together and lots of happy memories but at the moment I feel that everything has
    been taken away from me.

“Dominic was so unique (sic) , a hard man to replace in our lives. He was a hard-working man, he worked full time no matter what job it was to be able to support his family.

“It feels awful to no longer have that happiness around us. Our world is a lot sadder and empty since his death. Life is so hard everyday without Dom. It hits us all so hard that things will never be the same.”

Mr Fryer’s daughter Jessica said: “To say that losing my dad has left a big hole in every single moment in the day, in my life and that of my family is a massive understatement.

“He was the life and soul, my safety blanket, my hero and my dad.

“No matter what sentence is handed out it won’t heal what has been broken, it won’t bring back the time he should be here enjoying time with his kids, his grandkids and his family.”

And his son Joshua added: “Losing my dad has affected my life in every way. He can’t talk to us or love us and we all really feel poorer for that.

“I want the person who did this to know this has been the most difficult, heartbreaking loss to experience. We have been deprived of a loving husband, father, grandfather and friend to many. The world has lost an amazing man, one of the best I’ve
ever known. I love you dad.”

Another man, who was the front seat passenger in the vehicle, suffered serious injuries, including a fractured hip.

Boardman was trapped in the driver’s seat of the vehicle after the crash, which happened in Lullington Road, Overseal, at around 4.30am on 10 September 2022.

Tests found she was over the limit for alcohol, cocaine and cannabis at the time of the collision.

The 43-year-old, of Fernlea Drive, Linton, was subsequently charged with causing death by dangerous driving and causing injury by dangerous driving.

She admitted the offences and appeared at Derby Crown Court on Wednesday 22 November for sentencing when she was jailed for six years and banned from driving for 13 years.

Temporary Detective Constable Dan Booth, who led the investigation, said: “Whilst no sentence can ever bring Mr Fryer back or repair the damage done to the other victim in this case, I hope that today’s result will allow everybody involved to finally
    have some closure.

“This was a tragic and needless loss of life and is another reminder about the dangers of the so called ‘fatal four’ that police often speak about.

“Driving whilst impaired through drink or drugs, driving too fast for the conditions and not wearing a seatbelt are three of those four, which combined together, led to the loss of Mr Fryer’s life.

“I’d like to thank Mr Fryer’s family for the courage, dignity and restraint shown throughout this case and wish them well as they continue to try and rebuild their lives after such a dreadful loss.”

I can think of only one ex-poster here who would ever have spoken up for
her "right" to take drugs, though even he might have drawn the line at
heavy drinking in addition to the illegal drugs.

Harsh but fair, as one might say.

Temporary Detective Constable Dan Booth, who led the investigation, said: “Whilst no sentence can ever bring Mr Fryer back or repair the damage done to the other victim in this case, I hope that today’s result will allow everybody involved to

How did the defendant's failure to wear a seatbelt contribute to the
    incident?

Does it also mean that chav-on-bikes are more likely to kill pedestrians
if they (the chavs on the chav-bikes, that is) decline to wear a helmet?

    If not, what's the difference?

“I’d like to thank Mr Fryer’s family for the courage, dignity and restraint shown throughout this case and wish them well as they continue to try and rebuild their lives after such a dreadful loss.”

Rachael Boardman, who had been drinking heavily, had taken cocaine and smoked cannabis before causing the crash which claimed the life of Dominic Fryer, has been jailed for six years and disquaified from driving for 13 years. She has broken down in tears
    in the dock.

The judge said: "A forensic collision investigation was carried out and while Lullington Road is a 60mph limit the maximum safe speed to take that bend is 38mph and you admit travelling at 40mph. Travelling at that speed you failed to negotiate a
nearside bend, went across the opposite carriageway and drove head on in to a tree."

Judge Smith said: "In cases like this is really is impossible to know where to begin when I am sentencing somebody whose driving had changed the lives of so many people forever including your own family and those who have forever lost Dominic Fryer.
September 10, last year, was the worst day in Kristy's life as that is when she found out your driving had taken her husband's life. When you got in that car you were very drunk, at least twice the limit for alcohol as well as taking cocaine and smoking
    cannabis.

Judge Shaun Smith said: "It is not very often I get the mother of four children face such a lengthy sentence for a driving matter but we have a grieving family. Chidren aged five to 16 have all had to be placed in foster care." Mr Mohammed said: "She is
a single mother and there are five children, four dependant, and they are totally innocent here. She used to live in Stoke-on-Trent and tried to start a new life in Derbyshire bringing those kids up all by herself. She is truly remorseful and bitterly
regrets her actions that day and for causing the loss she has to so many people."

Mr Mohammed said: "She fully accepts the only sentence your honour can pass is one of custody and it is a matter of length. There is no dispute she had been drinking and she had been taking drugs and she made the fatal decision to take her friend, Mr
Osborne and his friend, Mr Fryer, home. She felt she was trying to help a friend out and she did not set out to cause the death and the injuries she did. She is really, really, sorry for what she has done. The combination of drinking and taking drugs led
to those disastrous consequences that day."

Rashad Mohammed, defending, said his client suffered 16 fractured ribs, a punctured lung, a dislocated hip and now has an issue with an artery to her heart as a result of the collision. He said she is "still suffering" with those more than a year after
causing the crash. OH DEAR, NEVER MIND.

Miss Harrison has read out victim impact statements made by Mr Fryer's family. In hers, his wife, Kristy, said: "25 years of marriage gone in one awful event. My husband Dom was everything to me and did everything for me. Life is hard every day without
    Dom."

Jess, Mr Fryer's daughter, said: "He was the life and soul, my safety blanket and my superhero."

And Joshua, Mr Fryer's son, said: "I never got the opportunity to tell him what he meant to me. When my son was born the first person I wanted to tell was my dad but I could not as he was not there anymore. I want the person who did this to know that the
world has lost an amazing man."

Mr Fryer was declared dead from multiple injuries at the scene, he was not wearing a seat belt. Later tests showed Boardman had cocaine, cannabis and alcohol in ner system. Miss Harrison said: "The lowest reading was 84 (micrograms of alcohol in 100
milliltres of blood) but a likely reading was 149 (the limit is 80) so she was just under twice the legal limit. The investigation concluded she was failed to negotiate a bend and collided head-on with the tree, there was no evidence of her being
distracted or using a mobile phone."

Miss Harrison said in the early hours of September 10 a taxi was called for Mr Fryer and Mr Osborne but instead Boardman chose to drive the men home. She said: "Females at the house noticed not only was she not there but the car was gone. After half and
hour there was a phone call (to them) from Mr Osborne which sounded panicked. They could hear the defendant saying she could not move her legs. At one point they could hear Michale Osborne saying 'you have killed him'."
